LOCATION OF INCIDENT: Interstate 40/ Mile Marker 178

 

While on patrol in the area of I40 and the 178mm K9/Officer McDougal noticed a white in color Ford F-150 having trouble maintaining lane control. K9/Officer McDougal initiated a traffic stop to investigate and found the driver, Timmy Miller, to have a suspended drivers license. Miller was asked to exit the vehicle and speak with K9/Officer McDougal at the rear of the vehicle. While speaking with Miller, K9/Officer McDougal noticed the passenger attempting to remove something from his right from pocket. K9/Officer McDougal asked Miller if he had any weapons to which he replied no and agreed to be checked. Deputy Telinger arrived on scene to further assist with the traffic stop. K9/Officer McDougal approached the passenger, James Mosley, and asked him what was in his pocket. Mosley stated he was not messing with anything, at this time he was requested to step out of the vehicle. K9/Officer McDougal  checked Mosley for weapons and located a white pill in Mosley's front pocket. Mosley stated it was Oxycontin and that he had a prescription. As the pill was removed from Mosley's pocket a small empty glass bottle was also found. Mosley was moved to the rear of the vehicle with Miller. Miller then gave consent for K9/Officer McDougal to search his vehicle after being made aware that the deputy was a K9 officer. K9/Officer McDougal conducted his search and located a black leather case under the passenger seat. The case held 2 syringes, a metal spoon, and cotton swab. After speaking with both parties about the items, Mosley advised the items belonged to him.

After being placed under arrest, Mosley advised K9/Officer McDougal and other deputies that he uses the Oxycontin without a prescription. Mosley also advised his method of use. Miller was charged with Driving while license revokes and taken to Davie County Detention Center under a $500.00 bond. Mosley was charged with Possession of Drug Paraphernalia and Possession of Schedule II Narcotic and taken to the Davie Detention Center under a $750.00 secure bond.
